TERMS & CONDITIONS

1. Introduction

Welcome to Waves Foundation.

Waves Foundation is a community initiative of Radio Tygerberg 104FM NPC, created to bring ordinary people together to make an extraordinary difference through hope, faith and practical community impact.

The Foundation is administered by Tygerberg Community Initiative NPC, Registration No. 2009/003061/08, a registered South African non-profit company established to support and facilitate the charitable work of Waves Foundation.

These Terms & Conditions govern your access to and use of the Waves Foundation website, including donations, recurring monthly contributions, online purchases (where applicable), and any related services offered through the website.

By accessing or using this website, making a donation, subscribing to a recurring contribution, purchasing products or services where available, or otherwise interacting with Waves Foundation online, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please discontinue use of this website.

2. Eligibility

By using this website or making a donation, you confirm that you:

• are at least 18 years of age, or have the consent of a parent or legal guardian;

• are legally capable of entering into binding agreements;

• provide information that is accurate, complete and up to date;

• will use this website only for lawful purposes.

Waves Foundation reserves the right to refuse services, donations, subscriptions or purchases where fraudulent, unlawful or suspicious activity is suspected.

3.Use of the Website

You agree to use this website responsibly and in accordance with all applicable South African laws.

You may not:

• use the website for any unlawful or fraudulent purpose;

• interfere with the operation, security or availability of the website;

• attempt to gain unauthorised access to any systems, databases or accounts;

• upload or transmit viruses, malware or other harmful software;

• copy, reproduce or exploit any content without prior written permission;

• use automated systems or bots to access the website without authorisation.

Waves Foundation reserves the right to suspend or terminate access where misuse is identified.

4. Donations and Monthly Contributions

Waves Foundation gratefully accepts voluntary once-off and recurring monthly contributions to support its charitable work.

By subscribing to a recurring monthly contribution, you authorise the payment provider to process the selected contribution amount using your chosen payment method each month until cancelled by you.

Recurring contributions:

• are entirely voluntary;

• do not constitute a fixed-term contract;

• may be cancelled at any time in accordance with these Terms;

• do not create any ownership, membership, voting rights or financial interest in Waves Foundation or Tygerberg Community Initiative NPC.

Donation amounts are displayed before payment is confirmed.

5.Payment Processing

Payments are processed securely by authorised third-party payment service providers, including PayFast or any successor payment platform selected by Waves Foundation.

Waves Foundation does not collect or store your full payment card details.

Where a recurring payment cannot be processed, the payment provider may attempt to process the transaction again in accordance with its own payment rules. Repeated failed payments may result in the recurring contribution being suspended or cancelled.

6. Accounts

Where applicable, users may create an online account to manage their recurring contributions and communication preferences.

Through your account you may be able to:

• manage your recurring contribution;

• update payment details;

• update your contact information;

• download available receipts or invoices;

• manage communication preferences.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Please notify us immediately if you believe your account has been accessed without your permission.

7. Cancelling Your Monthly Contribution

You may cancel your recurring monthly contribution at any time through the My Account section of the website or by contacting Waves Foundation.

Cancellation will stop future recurring payments but will not affect payments that have already been successfully processed before cancellation takes effect.

Cancellation does not automatically entitle you to a refund of previous donations or contributions.

8. Refund Policy

Donations are made voluntarily to support the charitable work of Waves Foundation.

Unless required by law or where an administrative error has occurred, donations and successfully processed recurring contributions are generally non-refundable.

Where a duplicate payment, incorrect amount or processing error has occurred, please contact us promptly so that the matter can be investigated and, where appropriate, resolved.

9. Allocation of Donations

Waves Foundation undertakes to apply all donations and recurring contributions, as far as reasonably possible, towards its charitable objectives and community initiatives.

While every effort is made to allocate donations to the projects or causes promoted at the time of giving, Waves Foundation reserves the right to redirect donations where necessary to meet urgent operational requirements, legal obligations, or other charitable needs that are consistent with its mission.

Donors acknowledge that contributions are made in support of the overall charitable work of Waves Foundation and not as payments for specific goods, services or guaranteed outcomes.

10. Communications

By providing your contact information, you agree that Waves Foundation may communicate with you regarding:

• your donations or recurring contributions;

• payment confirmations and receipts;

• account administration;

• important updates relating to your contributions;

• newsletters, campaigns, fundraising initiatives and ministry updates, where you have elected to receive such communications.

You may unsubscribe from promotional communications at any time by following the unsubscribe instructions contained in the communication or by contacting us directly.

Administrative communications relating to your donations or account may still be sent where reasonably necessary.

11.Electronic Communications

By accessing this website or communicating with Waves Foundation electronically, including by email, online forms or other electronic means, you consent to receiving communications from Waves Foundation electronically.

You agree that donation confirmations, receipts, notices, disclosures and all other communications provided electronically satisfy any legal requirement that such communications be in writing.

Nothing in this clause limits any rights you may have under applicable South African law.

12. WhatsApp Communications

Where you voluntarily subscribe to our WhatsApp communication service, you consent to receiving messages relating to:

• ministry updates;

• prayer requests;

• fundraising campaigns;

• community projects;

• events;

• other information relevant to Waves Foundation.

You may opt out of WhatsApp communications at any time by following the instructions provided within the service or by contacting us directly.

Message delivery remains subject to the availability and operation of WhatsApp and related third-party services.

13. Privacy and Protection of Personal Information

Waves Foundation respects your privacy and is committed to protecting your personal information.

Personal information collected through this website is processed in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy.

No content may be copied, reproduced, distributed, modified, published, transmitted or commercially exploited without prior written permission, except where expressly permitted by law.

18. Force Majeure

Waves Foundation shall not be liable for any failure or delay in performing its obligations under these Terms & Conditions where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, war, terrorism, civil unrest, strikes, labour disputes, pandemics, government action, power failures, telecommunications failures, internet disruptions or failures of third-party service providers.

During any such event, Waves Foundation’s obligations shall be suspended for the duration of the event, and performance shall resume as soon as reasonably practicable.

19. Changes to these Terms & Conditions

Waves Foundation reserves the right to amend or update these Terms & Conditions at any time.

Any changes will become effective upon publication on this website unless otherwise stated.

Your continued use of the website, or continued participation in recurring contributions after changes have been published, constitutes acceptance of the updated Terms & Conditions.

We encourage users to review these Terms periodically.

20. Severability

If any provision of these Terms & Conditions is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be regarded as severable from the remaining provisions.

The remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any other policies expressly referred to on this website, constitute the entire agreement between you and Waves Foundation regarding your use of this website and the services offered through it.

They supersede any prior understandings, communications or agreements relating to the same subject matter.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms & Conditions or the use of this website shall be subject to the exclusive jurisdiction of the South African courts.
